Heart Nightclub Sues City of Miami & Its Residents Over Enforcement of Noise Ordinance

Tensions are rising in the Park West neighborhood as Heart Nightclub has sued the City of Miami and its residents over conspiring to shut down the entertainment district. For years residents at some of Downtown Miami's most luxurious buildings including Marquis, Ten Museum Park, and 900 Biscayne have complained about noise from the 24-7 nightclubs located behind. Heart, Club Space, The Hanger and E11even, amongst others, have drawn late night crowds to the area for years. The city began enforcing citations over Memorial Day Weekend of this year and the clubs have since made efforts to reduce noise. Despite that, the area, which was once a desolate filled with homeless, crime and empty lots has transformed into the premier neighborhood in downtown. The ultra-luxurious One Thousand Museum will open next year, followed by PARAMOUNT Miami Worldcenter. On the other flank, MiamiCentral will bring a major transport hub with retail and dining. Residential populations, prices, and retail locations are all rising fast and residents feel that 24-7 clubs can at times be way to loud. The newer construction E11even, which is one of Miami's most popular hotspots, suppresses the noise extremely well but Heart and Club Space can become extremely loud at times as late as 6:30 am including a rooftop terrace which residents want enclosed; Heart estimates the cost would be over $1 million.

Once completed the residence sold within days for $6.8 million.
The 62-story One Thousand Museum by Zaha Hadid Architects is on track for delivery in 2018. The building is Zaha Hadid's first residential skyscraper in the western hemisphere and is being developed by Louis Birdman, Gregg Covin, Kevin Venger and the Regalia Group with Plaza Construction as the general contractor. One Thousand Museum's design features an exoskeleton design which acts as the buildings structural support. This allows the developer to remove columns from the units, creating expansive glass views of Biscayne Bay. The tower will feature only 83 units ranging from $5.5 million to over $20 million and 4,600 SF to over 10,000 SF. Amenities will include Miami's only private rooftop helipad, state-of-the-art fitness center, spa, two pools, indoor aquatic center, and a sky lounge. Plaza Celia, a new boutique mixed-use apartment building in Little Havana named after the late Cuban-born singer Celia Cruz, has officially broken ground. Plaza Celia will rise 4-stories and will feature 16 rental apartment rental units targeted at students and the local workforce with ground-floor retail. Units will come in 1 and 2-bedroom floor-plans and will range in size from 700 SF to 905 SF. Plaza Celia is located at 2640 SW 12th Street and is being developed by Metronomic, Inc. Metronomic, Inc. has been making waves in recent years with their business model of crowdfunding projects. Currently, Metronomic has 2 projects under development via crowdfunding, GroveHaus in Coconut Grove and Plaza Celia. Essentially, Metronomic identifies a development and goes under-contract for the land while developing the project. They then advertise the project on their crowdfunding platform to raise commitments for the crowdfunded financing from individual investors. Once they reach their dollar goal of crowdfunded investment, Metronomic simultaneously closes on the land, crowdfunded financing and additional financing previously committed by private lenders. In 2013 the Securities and Exchange Commission opened the prospects of crowdfunding to real estate investors via the JOBS Act. The JOBS Act stipulates that developers can solicit funds from the public, provided that the investors are accredited, meaning that they have a newt worth over $1 million or make in excess of $200,000 annually. Construction on Plaza Celia is expected to wrap up in Q4 2018.
Drama Heating Up Over Downtown's Proposed $800 Million Signature Bridge For I-395
The drama continues to heat up over the design and construction of Downtown Miami's proposed and approved, $800 million Signature Bridge, which would transform I-395. The drama continues to heat up over the design and construction of Downtown Miami's proposed and approved, $800 million Signature Bridge, which would transform I-395. A Miami-Dade judge denied a motion by FDOT to dismiss a lawsuit filed by former Miami City Commissioner Marc Sarnoff, who challenged the state's controversial choice of the $800 million "The Fountain" design by Archer Western and The de Moya Group. Sarnoff was a major advocate to get the bridge redesign approved, working with Miami Mayor Tomas Regalado to hold FDOT to their pledge to include the Signature Bridge as part of I-395's replacement. Sarnoff's case alleges that FDOT violated their settlement agreement via their handling of bids to design and build the bridge by manipulating scoring to allow the Archer Western and The de Moya Group's proposal to win. Another design by contractors Fluor, Astaldi and MCM, which finished in second, was allegedly the favorite design by community representatives. In their motion to dismiss, FDOT argued that the court venue was improper as another case is currently under review by Florida's Division of Administrative Hearings. That case is scheduled to be heard in November and December of this year (2017). Check-out the winning bid, "The Fountain" by Archer Western and The de Moya Group here.
